President Michel Temer sanctions Concessions MP

President Michel Temer has sanctioned (with vetoes) Law No.13,448/2017, which is the originating wording of the so-called Concessions Provisional Measure. The sanction was published in the Official Gazette this Tuesday (6 June).
The Provisional Measure (called MP in Portuguese) establishes the conditions for the extension and re-tendering of public-private partnership agreements in the road, rail and airport sectors. The rules are restricted to federal projects that are part of the Investment Partnership Programme (IPP).
The MP allows the extension of railroad contracts to include third-party transportation capacity obligations ("right of way") in order to guarantee access to railway infrastructure through sharing, as well as service quality parameters.
In addition, the text also authorises that contracts in the railroad sector contemplate new sections (or extensions to existing ones) to achieve the necessary length to meet cargo-generating areas. These investments will be carried out at the contractor's own risk, and will not generate indemnities at the end of the contract.
